中国大陆与台湾地区未成年人犯罪刑罚适用比较研究

摘　　要：我国大陆与台湾地区未成年人犯罪中"未成年人"的界定相同,未成年人犯罪刑罚适用种类也大多相同。我国大陆与台湾地区未成年人犯罪刑罚适用之差异表现为:未成年犯罪人的刑事责任范围不同,未成年人犯罪刑罚适用种类有一些不同;未成年人犯罪的具体量刑制度不同;在个别犯罪上对未成年人设置的刑罚不同等。通过比较得出对完善我国大陆未成年人犯罪刑罚适用的启示是:调整相对刑事责任年龄阶段人的刑事责任范围,在刑法中明确规定未成年人犯罪不适用无期徒刑和剥夺政治权利,增设针对未成年人犯罪的特别量刑制度等。There is the same definition of ＂delinquent＂ in delinquent juvenile in China's Mainland and Taiwan. And many types of penalties application to delinquent juvenile are similar. The differences of penalty application to delinquent juvenile in China's Mainland and Taiwan lie in fore aspects： the ranges of criminal responsibility for delinquent juvenile are different; the types of penalties application to delinquent juvenile are different; the specific sentencing systems for delinquent juvenile are different; the penalties for delinquents in individual crimes are different and etc. According to the comparative study, we can get the enlightenment for perfecting the penalty application to delinquent juvenile in China's Mainland： we should adjust the scope of the criminal responsibility for people＇s relative age of criminal responsibility; we should clearly define in the penal code that life imprisonment and deprivation of political rights don＇t apply to delinquent juvenile; we should add specific sentencing systems for delinquent juvenile and etc.
