黄河滩地的权利结构考察——基于产权经济学的视角

摘　　要：黄河滩地是自然力和人类活动共同作用下形成的宝贵土地资源,其数量和形态的变动性、属性的多样性、法律规定的简单性以及执法的软弱性等因素,使黄河滩地的实际权利结构远复杂于法理规定的所有权性质,黄委会、滩区群众和地方政府分别拥有基于黄河滩地的河道管理权、生存发展权以及土地开发权。近年来,黄河滩地潜在生产价值的不断提升,而有关滩地的法律法规等正式制度安排并没有相应改变,这导致黄河滩地的主要权利主体不断产生冲突和纠纷,因此,探索黄河滩地综合效率最大化的有效产权制度就具有重大的理论意义和应用价值。The Yellow River Beach is a kind of valuable land resource which has been formed under the joint action of the nature power and human being＇ s activities. The practical fights structure of the Yellow River is far more complex than the ownership fitted by the law, because of the variability of its magnitudes and shapes, the diversity of its attributes, the simplicity of the relevant law, the weakness of the enforcing the rules, and so on. The Yellow River Conservancy Commission owns the right of watercourse management, and the local governments seem be granted land exploitation, and the masses of the River beach area should own the rights to subsistence and development. In recent years, with the potential production value increasing, the fact that the formal institutional arrangements are not adjusted sufficiently has given rise to more conflicts and disputes among the entities of rights. In consequence, it is theoretically important and applied worth to explore the effective property right system of the Yellow River beach for maximizing its comprehensive utilization.
