美国农地征收制度及其对中国的启示

摘　　要：美国的农地征收制度已经有200多年的历史,其在长期的司法实践中积累的法治经验是人类优秀文明共同的成果,对当前中国正在积极推行新一轮的农地征收制度改革具有重大的借鉴意义。文章通过对美国的土地制度、农地征收的宪法准则、农地管制性征收和补偿机制的研究,以发现我国农地征收制度上的不足,并借鉴美国成熟的市场机制和法制框架下的农地征收经验,对中国当前农地征收制度的改革提出一些立法建议。The US system of farmland takings has a history of more than 200 years, it＇s experiences in its long judicial practices are the common achievements of the whole human civilization, which can serve as particularly useful and important reference to new transformations in the Chinese system of takings nowadays . This article studies US farmland system, categories of US system of takings, the main constitutional principles governing the government farmland takings, regulatory taking and compensation mechanism, in order to find the defects of Chinese system of takings. Based on the experiences of farmland takings from US mature market economy institution and framework of rule of law, correspnnding suggestions on legislation on Chinese system of takings＇reform are made nowadays.
