摘　　要：伴随互联网和信息社会的飞速发展,网络侵权现象愈加增多,个人信息权愈加脆弱,首要问题在于个人信息权在民事基本权利中的缺位,其次是法律制度缺陷及行业自律的滞后。在梳理评价我国当前个人信息权保护现状基础上,明确个人信息权的法律地位、推进《个人信息保护法》立法进程、重视特殊领域个人信息权保护、弥补刑法保护漏洞和构建于法律适应之配套制度将是应对形势发展的上策。With the development of the Internet and-information society,the phenomenon of network tort become more and more and the personal information right become more frail,the most important question lies in the vacancy of personal information right in civil rights;legal system defect and industry self-discipline lag are the second reasons.On the basis of evaluation of the protection status,to clear the legal status of personal information right,to advance the legislative process of the Personal Information Protection Law,to emphasize the protection in the special domain,to remedy the loophole of the criminal law and to contruct the related system will be the best countermeasures to deals with the situation.
