湖南茶类的地理标志知识产权与非物质文化遗产研究

摘　　要：湖南省茶类资源现有4种国家地理标志产品、7件国家地理标志商标、2种国家农产品地理标志。《国家非物质遗产名录》中,有3项与湖南茶文化相关的非物质文化遗产。研究了湖南省茶类的地理标志知识产权与非物质文化遗产的保护现状,并提出如下建议:(1)揭示名茶的地理标志特征;(2)加强保护茶类的非物质文化遗产;(3)以国家质检总局的地理标志知识产权保护模式为主;(4)充分利用地理标志专用标志;(5)充分利用地理标志这种农业品牌类遗产,整合同县域的同类茶的品牌;(6)大力发展茶叶休闲农业,保护性开发茶文化的旅游资源。There are four national geographical indication products,seven national geographical indication trademarks and two national geographical indication agricultural products in tea resources in Hunan Province.In the National Intangible Cultural Heritage List,there are three intangible cultural heritages that related to tea culture in Hunan.The protecting status quo of intellectual property right of geographical indication and intangible cultural heritage of the tea in Hunan Province was researched,and some suggestions were proposed as follows：（1） to reveal the geographical indication characteristics of famous tea deeply;（2） to strengthen protection for tea-related intangible cultural heritage;（3） to mainly use AQSIQ＇s protection mode for intellectual property right of geographical indications;（4） to make full use of geographical indication-specific trademark;（5） to make full use of the geographical indication,an agricultural brand heritage,to integrate similar tea-brand in the same county area;（6） to develop the tea related leisure agriculture and to protectively exploit tea-culture related tourist resources.
