摘　　要：医疗纠纷赔偿案件呈上升的趋势,对于何种医疗行为构成违法行为,就成了医患双方争议的焦点。本文从医疗医疗违法行为的构成要素出发,探讨医疗违法行为的方式,并就医疗违法行为的正当化进行论述。In recent years,compensation in cases of medical malpractice was a rising trend.Medical violation becomes a focus of controversy between doctors and patients.Medical violation constitutes of the two elements of medical behavior and illegal acts by the health care,and it can be divided into deed and nonfeasance.Justify of medical offense is that,although the medical staff implemented of the right to against the patient,the medical staff＇s behavior is legitimate,and thus the tort liability of medical personnel be removed.
