摘 要:研究目的:分析中国政府土地优先购买权实现的可行性与存在的问题。研究方法:结合中国相关管理法规与实践并与国外经验对比,对中国政府土地优先购买权的功能进行可行性分析。研究结果:中国政府的土地优先购买权在防止低价转让、储备土地来源、获得公共建设用地等方面的功能受到极大约束,主要是由于权利内涵的空洞和实施规范的缺失造成的,而深层原因是中国政府掌握着具有强制力的其他获取土地的手段。政府土地优先购买权功能在近期难以实现。研究结论:当前的政策环境使得政府土地优先购买权成为一个"空制度"。The purpose of this paper is to study the feasibility and problem of the land preemption right of government in China. Method employed is a comparative approach, i.e., comparing the relevant administrative regulations and practices in China with foreign experiences, and analyzing the feasibility of land preemption fight of government in China. The results indicate: the land preemption right of government in China is highly restricted within the functions of preventing low-price transfer, being land-banking source, acquiring public construction land, which is mainly due to the ignorance of rights connotation and the lack of practical regulations. The further reason is that Chinese government has other compulsive power in land acquisition. The land preemption right of government is difficult to be realized in the near future in China. It is concluded that the current policy environment resulted in the land preemption right of governments as a "hollow institution".
