摘　　要：银行担保作为独立担保最重要的一种形式,在国际经济贸易中得到广泛运用,但是规范银行担保的法律无论从国际层面还是国内层面都存在一些问题。对这两个方面的立法实践进行探讨并对其完善提出个人建议。As one of the most important forms of independent gurantee,bank guarantee is widely used in the field of international economic trade.However,there are some problems of the law which rules bank gurantee whether in the aspect of national or international fields.This essay mainly explores the legislative practices from the above two aspects and then puts forword some suggestions on their performance.
