摘　　要：监狱行刑是我国刑罚执行最重要的组成部分,其效果好坏直接决定着刑罚目的能否实现。罪犯劳动是我国监狱企业运行的主要载体,也是与监管、教育并列的行刑方式,起着不可替代的作用。我国监狱企业近年来面临一些困境,也影响到了监狱行刑。通过对罪犯劳动基本理论及在监狱行刑中存在问题进行研究,提出对我国监企制度的改进路径。Prison execution is the most important part of the punishment in the jails. It directly dertermins the effect of the penalty purpose. Criminal labour, as the supervision and education in the jail, is the main mode of the prison enterprises, and could not be replaced by other method. In recent years many problems appeared in the prison enterprises, which seriously obsessed the prison execution. Through analysing the basic theory and the prob｜ems of criminal labour, this article proposed some improvement methods to the prison enterprises of China.
