论联合国干涉朝鲜战争的合法性

摘　　要：朝鲜战争是联合国成立后爆发的第一场大规模国际性战争,联合国在美国操纵下组建联合国军入朝,参与了战争的全过程,并在民间救济、停战谈判等方面发挥了作用。联合国干涉朝鲜战争既是美国及其盟友操纵的结果,也是联合国与朝鲜问题关系发展的必然结果。联合国的决策虽有瑕疵,但履行了相应的法律程序,具有国际法意义上的合法性。承认联合国干涉朝鲜战争的合法性并不意味着否认中国人民志愿军抗美援朝的合理性与功绩。The Korean War was the first large - scale international war after the establishment of the United Nations. Under the manipulation of the United States, the United Nations established the United Nations forces to entry into the Korean and involved into the whole process of the Korean War, played a particular role in the civil rem- edies and armistice negotiations. The United Nations＇intervention to Korean War was the result of the manipulation of the United States and its allies, also was the inevitable result of the development of the relations between United Nations and the Korean problem. Although the United Nations decision -making had its defect, it discharged the corresponding proceedings, and had the legitimacy in the sense of the international law. Recognizing the legitimacy of United Nations intervene into the Korean War does not mean denying the rationality and merit of Chinese People Volunteer Army.
