摘 要:行政不作为的政治责任是指行政机关及其领导成员因自身或下属行政不作为而应承担的政治上的不利后果。该责任源于人民主权这一宪政基本原理,同时,政治—行政二分理论和官僚制理论也为其提供了理论注脚。国外行政不作为政治问责的常见形式主要有公开道歉、引咎辞职、职务罢免,主要问责机制有质询机制、辞职机制、倒阁机制(罢免或撤职)、选举机制等。完善中国的行政不作为政治问责制度,落实行政不作为政治责任,必须实现行政不作为政治责任的法制化,同时应健全以异体问责机制为重点的行政不作为政治问责机制。The political responsibility of administrative omission means an adverse political consequence that the executive authorities and their leading members should bear for administrative omission of their own or subordinate.Its theoretical basis lies in the constitutional principle of popular sovereignty,T.W.Wilson's political-administrative dichotomy theory and Max Weber's theory of bureaucracy.In western countries,the most common form of political accountability of administrative omission includes a public apology,resignation and removal from office.The mechanism of political responsibility of administrative omission mainly includes question mechanism,the resignation of mechanism,confidence vote mechanism(removal or dismissal) and the election mechanism.In order to realize the political accountability of administrative omission in our country,we must normalize it by law and improve political accountability mechanisms,in particular,the external political accountability mechanisms should be strengthened.
