摘　　要：海上保险中的保证制度起源于英国,它是海上保险法中一项特有的制度。保证制度经过长期的发展与演变,具有十分丰富的内涵。随着科学技术的进步和国际航运事业发展,当代国际海上保险立法与司法呈现出更倾向于被保险人利益的特点,保证制度的发展也顺应了这一潮流。我国《海商法》对保证仅有一条原则性的规定,难以适应海上保险实务之需要。应借鉴航运发达国家之相关立法,以完善我国海上保险中的保证制度。The guarantee system in the marine insurance originated in the United Kingdom,which is a unique system in marine insurance law.The guarantee system has very rich content over long-time development and evolution.With the scientific and technological progress and the development of international shipping industry,the contemporary international marine insurance legislation and justice are more inclined toward the interests of the insured.The guarantee system also conforms to this trend.The guarantee system in China＇s Maritime Law has only one provision of principle,so it is difficult to adapt to the needs of marine insurance practice.We should learn the relevant shipping legislation from developed countries so as to improve our guarantee system in marine insurance.
