摘　　要：非法吸收公众存款案件的犯罪构成特征是:犯罪主体为一般主体,现实案件中多表现为"单位+自然人"的形式;犯罪主观方面只能为故意,且大部分为间接故意;犯罪客体为复杂客体,其现实客体是我国的金融管理秩序,可能客体则是投资人的财产权利,具有较大的社会危害性;犯罪客观方面,统而言之为非法吸收公众存款或变相吸收公众存款的行为,现实中更多的是非法变相吸收公众存款行为。打击防范非法吸收公众存款案件要重点加强经济主体的市场监管和信息透明度建设,改进公安工作思路,从就案破案的被动型向无案防案的主动型工作模式转变,加大该犯罪行为的打击力度。The characteristics of crime of illegal collecting public deposit include that the criminal principal is a general principal,which often present in the form of ＂unit＋ natural person＂ in the factual case;the criminal subjective aspect should be with intention,and mostly indirect intentionally;the criminal objective is complicated： the realistic objective is the financial management order and the probable objective is the property right of the investor.It has huge social imperilment.Its criminal objective aspect is to illegally absorb the public savings or absorb public savings covertly.To strike them,we should strengthen the supervision on market and information clarity construction,improve the police work thinking from passive type to active,and enlarge the strike strength on this criminal offence.
