从冤假错案看逮捕证明标准的完善

摘　　要：逮捕制度是控制犯罪,保障人权的第一道防线,而逮捕证明标准是逮捕制度的核心。我国逮捕证明标准主要存在证明标准表述笼统模糊,证明标准过低等问题。而这些问题的存在与逮捕制度本身的缺陷密切相关。在现今的环境和条件下,最佳的解决方式是提高逮捕证明标准,使其与羁押的标准相适应,同时,也提出了对我国逮捕证明标准如何进一步完善的建议。The system of arrestment is essential to the crime control and assurance of human rights.While the arrestment proof standards is a core problem in arrest system.In the author＇s opinion,the main problems of arrestment proof standards in our country are ambiguous in the expression and loose proof standards.All these are closely related to the situation of arrest system.In this paper,the author suggests that,during current circumstances,a better way to solve those problems is raising the standards to correspond with detention standards.In the mean time,the author put forwards her own ideas about improvement of the arrestment proof standards.
