物权法视角下的殡葬用地问题探析

摘　　要：目前在法律缺位及滞后情况下,殡葬暴利促使非法用地现象日益猖獗,不仅破坏了生态环境,更产生一系列法律问题。以物权法为视角进行理论分析,指出现行制度的缺陷和存在的诸多法律问题,通过比较、借鉴国外及中国台湾地区相关法律,提出构建中国殡葬用地法律体系的设想。Nowadays,on the condition of lack and lagging of law,more and more cemetery is illegal used with big profits.Thus the illegal deed destroys the environment and brings a series of legal problems.The paper carried out theoretical analysis on these problems from viewpoint of property law,and pointed out the defect of current system and some legal problems about cemetery.Through comparing and referring the related law of foreign countries and Taiwan Province of China,it conceived some regulations for building China＇s cemetery legal system.
