摘　　要：农村土地承包经营权流转行为是农村土地承包经营权流转制度研究的重要课题。我国现有立法已对农村土地承包经营权流转行为作了较为详尽的规定。我国农村土地承包经营权流转行为具有典型的二元性特征。作为研究偏远山区农村土地承包经营权流转行为的基本路径,流转行为的二元性理论主要围绕流转行为的类型学研究和基本冲突及其法律解决来展开。The rural contracted land management right transfer behaviors are important topic for studying the system of rural contracted land management right transfer.China＇s current legislation has made some detailed regulations for rural contracted land management right transfer.In China,the behaviors of rural contracted land management right transfer have typical dual characteristics.As the basic path for researching the behaviors in remote mountainous areas,the dual theory for the transfer behaviors is mainly carried out on typology research and the legal solution to basic conflicts.
