摘　　要：文章通过分析我国集体合作制、家庭联产承包责任制两种土地制度下各主体的产权变化,提出产权闭合的概念,从阶层和利益的角度研究土地流转过程中阶层群体及其产权状态,探究土地流转的约束条件。文章认为,在土地流转条件下,土地产权主体发生裂变,各主体的利益和产权状态变化直接决定土地流转的范围、规模和制度走向。要推进土地流转,获取农业生产的规模经济效应,必须充分重视土地对农民的保障功能,并进行合理的剥离和替代,实现农民产权闭合。The purpose of this paper is to analyze the owners＇ property rights change under the collective cooperation system and the household contract responsibility system by the concept of property rights closure,study the class groups and their property rights status on the process of land transfer from the perspective of the interests and class,and explore constraints of land circulation.The result of observation is that owners are occurring fission on the condition of land transfer,owners＇ interests and their status of property rights closure determines the scope,scale and moving direction of land transfer system.If we want to promote land transfer and access the scale economies corresponding of agricultural production,we must pay full attention to the protection capabilities of land for farmers and strip it from land,carry out a reasonable alternative and realize the farmers＇ property closure.
