摘　　要："以事实为依据,以法律为准绳",是我国一项基本的法律原则,我们用以审判的"事实"究竟是绝对事实(客观真实),还是相对事实(法律真实)?在司法实践中,客观真实与法律真实发生冲突时不能把两者对立看待,应在联系的观点下全面看待这两种真实。That＂Take facts as the basis and the law as the criterion＂ is one of the basic law principles of our country.But the facts we used to judge is the objective truth or the real the legal truth？ We should choose fact when they conflict in judicial practice.In this paper,we will analysis about this question.The writer thinks we should see it as an entirety.
