浅议我国债券市场的制度改革——从改革《企业债券管理条例》开始

摘　　要：本文着重分析《企业债券管理条例》内容中所存在的管辖范围不清、监管规则重叠、交易市场定位错乱、计划色彩显著以及导致资源配置效率低下与不公等种种问题,进一步讨论了我国债券市场制度改革的几个方向。我们认为,《企业债券管理条例》已经无法适应我国债券市场进一步发展的需要,债券市场的制度改革方向应以行政放权为基础,兼顾市场的公平性和效率性、增加制度的包容性,并以自上而下的方式进行。In this paper,many problems of the ＂Corporate Bond Regulations＂ are analyzed,such as ambiguous jurisdictions,overlapping regulatory rules,disordered market orientation,obvious planned behavior,leading to inefficient and unfair allocation of resources.The potential directions of the reform of China＇s bond market are also discussed here.We believe that ＂Corporate Bond Regulations＂ has no longer fitted the needs of the further development of China＇s bond market,the reform of the bond market should base on the administrative decentralization,fairness and efficiency of the market.The inclusiveness of the system should be increased and the reform should follow a top-down manner.
