民商事的一个重要司法原则

摘　　要：我国产业结构调整和节能减排重大决策实施后,民商事合同不能履行引起的纠纷如何解决,本文提出情势变更原则是解决这类民商事纠纷的一个重要司法原则。通过对《合同法》立法进行分析,对关于这一原则的各种理论学说进行了分析比较,并进行了理论上的探讨思考,进而提出了确立我国情势变更原则的理论依据,法律平衡理论是这一原则的理论依据和指导思想,法律的平等自愿原则、公平原则、诚实信用原则是这一原则的法律依据和法律来源,本文对这一原则的内容进行了准确、清晰的表述。After the implementation of China＇s major policy about adjusting industrial restructures and saving energy and controlling emission,how do we resolve disputes resulted by not performing civil and commercial contract.In this paper,the principle of circumstance change is put forward to resolve this kind of civil and commercial disputes.Through analyzing the legislation of ＂Contract Law＂,this paper analyzed and compared theory of this principle,conducted discussion and thinking,and then proposed the theoretical basis of the principle of circumstance change.The legal equilibrium theory is the theoretical basis and the guiding ideology of the principle;the law principles of the equality,voluntariness,fairness and good faith are the legal basis and the source of this principle.At last,the article presents accurately and clearly the content of the principle.
