摘 要:不动产善意取得的时点应区分不动产登记簿错误的客观时点和取得人善意的主观时点,前者应以不动产登记时为准,后者一般情形下以提出登记申请时为准,如果不动产登记簿错误发生在提出申请之后的,则以该时点为准。不动产善意取得的善意为推定善意,取得人应负有必要注意义务。The moment of bone fide in bone fide acquisition of real estate should be distinguished as objective moment of Bone Fide and subjective moment of Bone Fide.The former of them is subject to the moment of real estate registration,and the later usually takes the moment of application for registration as final.When the falsity of real estate register happens after the application,this moment will be considered as critical.Bone fide of bone fide acquisition of real estate is presumption of bone fide,the acquisitor must take the duty of care.
