摘　　要：目前我国现行法律对药品平行进口问题还没有明确的规定,从我国的经济情况和所执行的经济政策出发,提出在知识产权领域应采用权利用尽原则,允许药品平行进口,并通过相应的合同法予以调整,海关法予以保障。At present,there are no explicit regulations about the medical parallel imports in laws.According to the economic situations and policies in our country,this paper puts forward that exhaustion-of-rights doctrine should be adopted in the area of intellectual property rights and the medical parallel imports should be permitted,which are adjusted by contract law and guaranteed by customs laws.
