摘　　要：运用美国威廉?M?兰德斯与理查德?A?波斯纳的经济学分析与社会收益理论探析中药组合物专利"三性"的内涵及意义。认为严格规制中药组合物专利的"三性"对于增强社会整体收益意义重大。具备"三性"而获准的中药组合物专利应给与充分的保护,同时在专利权人与社会公众之间构建平衡机制。Objective：To discuss the social benefit and economic value of the traditional Chinese medical composition＇s three properties.Methods：The traditional Chinese medical composition＇s three properties are discussed by use of economics analysis and social benefit theory created by William M.Landes Rechard A.posner in American.Results and conclusion：It is important for the social whole benefits＇ growth to regulate the traditional Chinese medical composition＇s three properties strictly.In addition,the authorized traditional Chinese medical patents which contain three properties should be protected absolutely.At the same time,the balancing mechanism ought to be built up in the patentees and the public.
