摘　　要："资源"是一个已为学界关注且解释力极强的概念,其与法律复杂交融的关系不仅为法史研究提供了新的切入视角,而且为传统法制史中的诸多问题提供了新的解释路径,其与社会学的结合更为学界深入探究传统法制提供了广阔的空间。笔者在本文中此将制度设计引入资源与法律的解释框架中,使之成为"隐"的资源与"显"的法律之间的考察定量。通过制度设计、资源分析与法律变迁间的相互关联形构底层为资源、媒介为制度、表层为法律的分析脉络,以求对传统法律中部分问题的研究更进一步。＂Resource＂ is a concept that has received a good deal of scholarly attention and interpretation.The complex relationship between resource and law not only provides a new angle for the research of legal history,but also a new path for explaining many problems in traditional legal history.The combination of legal research with so-ciological methods provides a wider space to further probe into the traditional legal system.In this essay,the designof institutions will be introduced into the interpretative framework of resources and law,making it an analysis be-tween the ＂hidden＂ resources and the ＂significant＂laws.We can further study various issues of traditional lawthrough the analysis of the venation of law,institution and resource which is based on the design of institution,resource analysis and legal changes.
