摘　　要：商事侵权责任是现代市场经济条件下所发生的新型侵权责任,是商事主体在商业经营活动中侵害他人合法权益应承担的商事赔偿责任。商事侵权责任区别于传统民事侵权责任,其归责原则以严格责任为基础,责任形态经济化,其侵害的客体也较为复杂。鉴于商事侵权责任内涵的独特性和区别于一般民事侵权责任的特点,在未来的制度设计方面必须有所反映。Commercial tort liability is a new form of tort liability that takes place under the modern market economy.It is the commercial liability arised from the main commercial activities of the commercial main body which infringed on the other people＇s legal rights and interests.The commercial tort liability is different from the traditional civil tort liability.Its responsibility principal is based on the strict liability and its liability form is economized.The objects abused is also more complex.In view of that,the content of the commercial tort liability is unique and is different from the characteristics of the general tort liability.It must be reflected in the future system design.
