摘　　要：我国的离婚损害赔偿制度已初步建立,该制度对于抚慰受害方,惩戒过错方,维护婚姻家庭关系的稳定,都具有非常积极的意义,但由于立法上的不足,导致该制度还存在较大的缺陷,不利于对受害方合法权益的充分保护,仍需进一步加以完善。The system of the compensation of mental harm in Divorce in China has been primarily set up,which plays an active part in placating victim side and chastening offence side so as to maintain the stability of marital and family relationship.Due to the deficiency in legislature,the system,however,has somehow flaw and is disadvantageous in protecting victim＇s legal rights.Therefore it needs to be further perfected.
