数字图书馆建设中的知识产权问题探析

摘　　要：随着信息社会的到来,建设高质量的数字图书馆已经成为世界范围内图书馆界加强自身建设的必由之路。我国数字图书馆自20世纪90年代末正式提出和实施以来,已取得了一定的成效,具有相当规模。然而,伴随着数字图书馆建设的深入开展,知识产权问题日益突出,成为数字图书馆面临的最为复杂和最具挑战性的问题之一,也是人们普遍关注并着力解决的关键性问题。本文主要从法律的角度分析了数字图书馆建设过程中涉及的知识产权问题,并就此在法律的框架内提出了数字图书馆知识产权保护的途径。With the advent of the information society,building a high-quality digital library has become the only way for libraries to strengthen themselves.Digital library in China proposed and implemented since the late 1990s has made some achievemnets and reached a considerable scale.However,along with the in-depth development of digital library construction,intellectual property problem is becoming increasingly prominent,and has become one of the most complex and challenging problem digital library is facing.It has been concerned generaly in this field,which people are striving to resolve.From the legal perspective,the author analyzes the intellectual property issues involved in process of digital library construction,and proposes the approach to the intellectual property protection of digital library within the law framework.
