法治现代化下私权在公司法内的扩张

摘　　要：法理学研究的重要课题之一就是现代社会下的法治现代化。法治现代化下的公司法内部私权不断扩展,既展现出了法治现代化对公司法发展的影响,亦展现了私权在商事法律主体内部蓬勃发展的面孔。公司法内部私权不断扩展展现为三个方面,即,强调平等精神与主体意识,使商事私权主体不断扩大;自由精神的承认和权利意识的接受,使私权客体范围逐步扩展;社会责任精神的强化,使弱势群体的私权获得一定保护。Modernization of law is an important issues under the modem society in jurispruderce The private right is expend in commpany law under the modernization of law, not only show the the impact of company law by the modemization of law but also demonstrates the flourish development of private right in the Commercial Law. Private right expand in the company law show for the three aspects, namely, the main emphasis on the spirit of equality and awareness, which make the main private entiW expansion recognize freedom of the spirit and acceptance of the rights consciousness, which make the scope of private rights object expand gradually strengthen the spirit of the resporbility, which make the vulnerable weak groups receive some protection of private right.
