摘　　要：谢吉斌认为"劳动力所有权是从人身权中直接分化出来的所有权,它的存在先于并决定着物质形态的所有权",这种论断是不能成立的。劳动力所有权不是从人身权中直接分化出来的,也不是先于"物质形态的所有权",更不决定"物质形态的所有权"。Xie Jibin argued that＂the labor rights of ownership directly from the ownership of the person,and its existence precedes and determines the physical form of ownership,＂ this assertion is untenable.Ownership of labor is neither directly from the personal rights,nor is the premise of the ownership of the material form or does determine the ownership of material form.
