清代秋审制度执行特点探析

摘　　要：秋审制度在执行时,其方式并不是固定不变的,而是根据其实际情况,将传统伦理道德融合当中。秋审制度还根据犯人罪行对社会危害的大小,将犯人分为实、缓两种,但由于清代秋审有关条例自身的缺陷,使其在执行中受到各方面因素的困扰。特殊案件在审理时,执行者也采取特殊的处理方式。The execution of Autumn Trial System was flexible in different cases.Thus,the integration of traditional ethics was concerned during the execution.As a result,execution was divided into real punishment and probation according to the criminal offence to the size of the social harm.However,the implementation of the autumn trial system was affected by various factors due to its own defects.Executives also took special approaches in terms of special cases in trial.
