摘　　要：低碳发展的实现路径主要包括制度创新和技术创新,其发展与专利政策密切相关。低碳发展将在专利申请量、技术类型、职务发明比例等方面对专利工作产生影响;同时,对专利工作在审查速度、审查方式、审查员的知识结构、人财物的配置等方面提出要求。我国现有专利政策是传统经济发展模式下制定的,存在诸多不适应低碳发展要求之处。为应对低碳发展的需求,专利政策应当以促进低碳技术创新为准则进行变革,从而为低碳发展的实现提供专利政策支持。The system innovation and technology innovation are the main ways to promote the low-carbon development,which is closely involved in patents policy.Firstly,The patent system will affect the quantity of patent applications,types of technology,the quantity of service inventions,and so on;Secondly,it will generate needs for the patent system in the aspects of the speed and types of examination,structure of knowledge of the patent examiners,management system of human,financial and material resources,etc.The patent policy of china is based on the traditional pattern of economic development,which displayed unsuitability with the low-carbon economy.In order to develop the low-carbon economy,the patent system of china must be reformed according to the needs of the low-carbon technology innovation.
