摘　　要：当市政公用事业特许经营陷入危机时,政府应采取行政接管保障特许经营项目的连续性与稳定性。通过规范分析和法理论证,尝试重构我国市政公用事业特许经营的行政接管法律规范体系。提出应确立接管的主体,明确接管启动原因与程序,改进接管的决定机制,完善接管措施,健全接管的后续处理及救济措施。When urban public utilities concessions projects get in trouble,the government should take effective measures to safeguard the continuity and stability of concessions projects.By normative analysis and jurisprudence demonstration,this article tries to re-establish system of administrative taking over in urban public utilities concessions.The measures are brought forward such as delimiting the subject of taking over,improving the decision mechanism and countermeasures,and strengthening post-treatment and relief system.
