摘　　要：新疆首例KTV经营者诉音像、音乐著作权管理机构案的分歧在于中国音像著作权集体协会收费权利的正当性、收费标准的依据、授权收费的范围。通过对焦点问题的法律分析,可知著作权集体管理组织具有合理性与合法性,程序合法、协调机制以及技术发展是解决收费争议的出路,延伸集体管理授权、引入默示许可扩展法定许可使用制度是获取授权的有益方向。The differences in the first case of KTV operators v. MCSC and CAVCA in Xinjiang are the validity of CAVCA＇s charge right, the basis of charge criteria and the scope of authorized charge. We can draw the conclusion from the legal analysis of focal point questions that the organization of copyright collective management has the rationality and the validity, that the solution to charge dispute lies in the legitimate procedure, the mediation mechanism as well as the technological development, that the beneficial direction to gain authorization is to expand the statutory permission use system by extending the collective management authorization and implied license system.
