摘　　要：土地空间权的"空间"应界定为在土地分层利用中,能为人所支配,可通过长、宽、高进行度量的土地上下特定空间,包括离开地表之空中或地中横切之断层空间,以及地表上下一定范围的空间,但不包括外层空间、具有通航自由的上层空间、极深的地下空间以及建筑物或构筑物内的空间。空间是物权法上的物,可以成为物权的客体。The word ＂space＂ in the ＂land space right＂ should be defined as specific space,which can be dominated by man and measured by its length,width,and height in the hierarchical use of land including the space of the air above the surface of the land or below the surface of the land,and a range of the surface of the land,but excepting the outer space,navigable upper space,deep underground space,and the space within buildings or structures.Space is a real right law subject and can be used as the object of real right.
