摘　　要：研究WTO/DSM非违法之诉的成立要件和非违法之诉的程序规则,分析WTO以往案例,阐述非违法之诉的本质和适用范围,美国若在WTO/DSM对人民币汇率争端提起违法之诉,是滥用WTO争端解决机制的表现是不可行的。This paper studies the established conditions and procedural rules of non-violation complaints in WTO/DSM.It analyzes previous cases of WTO and expounds the nature and application scope of non-violation complaints.This research finds that the performance of America to institute non-violation complaints in WTO/DSM against RMB exchange rate conflict is the abuse of the WTO dispute settlement mechanism and it is thus infeasible.
