摘　　要：在风险社会中,自然灾害的发生与人类活动具有各种复杂的关联性,同时,自然灾害往往破坏了人类社会正常运行所依赖的基础和条件,而传统的法律体系不足以应对,需要确立风险损害分配和权益调整的新原则和制度。对此,本文运用既有的法理和制度,结合风险应对所需要的目标和策略,以推导构建出风险社会中应对自然灾害的法律原则和制度。就自然灾害下的房地产权益而言,土地用益物权并不随着房屋的毁损而当然消灭,应根据灾后的土地用益功能的具体情况而作出相应的处理。同时,根据自然灾害的不同情形,国家和民间社会等相关方需要在灾害预防、保险机制和恢复重建等方面承担在风险社会中的应有责任,以恢复风险社会正常运行所依赖的基础和条件。There are complex relations between natural disasters and human activities in risk society.Natural disasters frequently destroy the basis and conditions on which human society depend.Since traditional legal system cannot address the problems caused by natural disasters,new principle and system with regard to risk loss distribution and benefit balance should be established.Employing existing jurisprudence and system concerning natural disasters and introducing new goals needed for dealing with risks,this article derives legal principles and system dealing with natural disasters.As far as the real estate under natural disasters is concerned,land usufruct may not be terminated when a building is damaged,and it should be handled according to the concrete condition of land usufruct.Depending on the extent and type of natural disasters,government,civil society and other concerned subjects should undertake their due duties in the disaster prevention,insurance system and restoration to the normal conditions on which the operation of risk society depends.
