英国奥林匹克知识产权保护立法及对我国的启示

摘　　要：英国率先颁布专门法以保护知识产权,现已有较为全面的专门立法以保护奥林匹克知识产权。将2012伦敦奥运会相关知识产权保护法的法案与其他法系国家相关法案进行比较,从中可总结出"以法护权"的成功经验。在此基础上提出修正既有法律,扩大立法范围和增加奥标使用例外条款以及提高解决侵权纠纷的效率等建议。借此完善我国奥林匹克知识产权立法的制度,实现"后奥运时代"奥林匹克知识产权得以全面保护的目的。U.K.is the first country that enacted special laws to protect the intellectual property right,and it has had more comprehensive special legislation of Olympic intellectual property right.This essay compares the relevant legislation of the intellectual property right of London 2012 Olympic Games with that of other countries,sums up successful experience of protecting Olympic intellectual property right,and puts forward suggestions concerning improvement of the legislation of the Olympic intellectual property right of China： amending the current law,expanding the scope of legislative protection,adding escape clauses of Olympic symbols＇ usage and promoting the efficiency of settling disputes etc.,which is to achieve the comprehensive protection of the Olympic intellectual property right in post-Olympics era.
