摘　　要：在刑事责任能力评定工作中存在的突出问题是对法律、法规的理解不一致,掌握尺度不一致,最终造成评定结果不一致;目前正在制定全国统一的精神病人刑事责任能力评定标准,有必要对评定刑事责任能力法律依据、评定原则、评定方法和特殊状态下刑事责任能力评定等进行深入理解、再认识。Assessment of criminal responsibility in the work of the outstanding problems is the laws and regulations inconsistent with the understanding,master scale is inconsistent,and ultimately result in inconsistent assessment results;currently being developed in the spirit of a unified national standards for mental patient assessment of criminal responsibility,it is necessary to assess criminal responsibility ability of the legal basis,assessment principles,assessment methods and assessment of criminal responsibility under special state such as in-depth understanding of,and again knowledge.
