集体土地流转中集体角色的错位与回归

摘　　要：推进集体土地流转,加强农民集体权益保护需要其代表——集体找准角色定位,发挥积极作用。然而,在实际土地流转中,集体背离了其整体利益代表的角色定位要求,扮演了土地流转个人利益最大化的强夺者和乡(镇)政府以及办事处利益顺从者的角色,严重的角色错位侵害了本集体其他农民的合法权益。切实推进集体土地流转、加强农民权益保护,应从乡(镇)政府、农民、集体自身三方面入手摆正集体角色,切实保护农民的权益。To promote the collective land circulation and to protect the farmers＇ right and interest, a representafive--the group--is needed. The group should identify its position rightly and play a positive role. However, in the real case of land circulation, the groups deviate from its role of representing the overall interests. On the contrary, they play the seizer of farmers＇ interest and the compliance of govemment and its agency. The serious dislocation of role damages farmers＇ interests. To facilitate the circulation of collective land and strengthen the protection of farmers＇ right, it is necessary to rightly set the role of the group from three side sof the government, the farmer and the group itself, giving real protection to farmers＇ right.
