摘　　要：讨论了一元归责论和二元归责论。分析了公平责任原则,认为其不是归责根据的原则,只是一种赔偿范围的考量因素。对《侵权责任法》第87条公平责任归责原则作了评析,认为对其进行适当修改更能彰显公平正义的和谐理念。The unitary ascription of responsibility and dual ascription of responsibility are discussed.The fair liability principle is analyzed,which is not considered the basis of ascription,but the consideration of the scope of compensation.The principle of fair liability in Article 87 of Tort Liability Law is commented,it is considered that appropriate changes in it can better demonstrate its harmony ideas of fairness and justice.
