摘　　要：调解是中国传统社会最具有代表性的司法形式。对调解进行语境化分析可以有效探知调解在当时社会语境下的正当性、合理性以及局限性,从而为当今社会法治建设提供借鉴。Mediation is the most cultural and typical justice form in Chinese traditional society.Contextualized Analysis about the mediation can discover the legitimacy and limitation in that social context,so as to provide reflection and reference for rule of law.
