摘　　要：我国刑事法律的现行规定并不支持被害人在精神损害方面获得赔偿,刑事精神损害赔偿在我国刑事法学界是一个讨论已久的问题,刑事惩罚性赔偿制度将能够解决这一问题。我国现有的刑事赔偿制度具有一定的局限性,而刑事惩罚性赔偿制度将为被害人提供充分的救济。作为一种非刑罚处罚方法,其可以均衡地保护被害人和犯罪人的合法利益。The existing provisions of criminal law do not support the victims for their mental damage compensation claims.This long-lasting topic would be addressed by the regulations on criminal punitive damages.China＇s current criminal compensation system has some limitations,while punitive damages,as a method of non-criminal penalties,would provide adequate relief for criminal victims,and would symmetrically protect the legitimate interests both of the victims and the perpetrators.
