摘 要:我国当前法律运行过程中存在严重的行政依赖,有害于法治。应该将司法最终原则树立为法治的基本指导原则,将其贯彻到法律运行各环节,以司法裁判作为化解冲突和矛盾的终极手段。该原则的贯彻需要保障有效的审判独立,化解当前司法地方化困境,并且将可司法性作为立法质量的基本标准,便于社会权力通过司法对公权力守法进行监督。为了保障司法公正和公平,应该强化司法程序化、透明化,可以在人大制度框架内构建我国的法官弹劾制度,落实司法最终原则,确保法院和法官守法。In our country, the operation of law are too dependent on the administration, which is harmful to the rule of law. Principles of judicial ultimate resolution should be the basic principles of the rule of law, i.e. any individual's fights and remedies as well as national public power community should insist on the operation of the power of judicial review of fmal order to resolve the administration of justice as the ultimate means of conflict and contradiction. The need to guarantee the effective implementation of the principle of judicial independence, and resolve the plight of the current localization of Justiee and judicial convenience as a basic standard of quality of legislation; protection of social rights through the judicial and law-abiding public authority to supervise the judicial authority to protect resistance, impeachment of judges need to build and improve the system.
