摘　　要：作为一种法律上回溯性拟制职业过程的技术,职业生涯再造是在公务员人事管理决定被有权机关撤销时保障公务员合法权益的一项有力措施。法国早在1925年就通过判例形成该理论,要求行政机关全面、切实地实现法院撤销判决所具有的溯及既往的效力,从职位复得、晋升利益保障和损害赔偿等方面保障受违法不利行政决定影响的公务员的合法权益。As a technology of legal retrospective fiction of career process,re-creation of career is a effective measure to protect the legal interests of civil service when personnel management is revoked by authority.The theory was formed through the case in France in 1925,requiring the executive to fully and effectively implement the court decision which had the retroactive effect.The executive should protect the legal interests of civil service from illegal executive decisions in terms of the positions restoration,promotion and damages.
