摘  要:中国农村城镇化道路与现行土地制度存在矛盾,必须深化农村现行土地制度的改革。土地股份合作制能够在坚持土地集体所有权和家庭联产承包经营权稳定不变的前提下,解决农村城镇化道路与现行土地制度存在的矛盾,起到了城镇化道路的载体和推进器作用。在土地股份合作制中,集体土地产权关系明确,可提高集体对国家的谈判力,迫使国家政府官员不能在征收农民土地中随意侵犯农民利益。并且,在一般情况下,国家不一定非要通过征地方式使用农民土地,完全可以通过土地股份合作制方式开发和使用农民土地。There is contradiction between the urbanization route in the rural area and the current land system. So it is necessary to reform the current land system in the rural area. The joint-stock cooperative system can resolve such contradiction while maintain the collective ownership of land and the household contract responsibility system so it can act as the carder and booster for the urbanization. In the land joint-stock cooperative system, the clear collective land ownership can increase the role of the collective in negotiating with the government so that the officials can not offend the farmers benefits in taking over the land. Also, at usual times, the government may as well develop and use the farmers land in the form of land joint-stock cog.perative system.
