公共行政变迁下行政权的重新界定

摘　　要：随着民营化、行政外包等现象的出现,政府职能逐渐向社会转移。公共行政的变迁使得传统行政权的界定遭遇挑战。"行政权"本身也是一个发展变化的概念,时代赋予了行政权新的内涵。行政权的不可处分性、强制性、国家意志性已经不足以解释公共行政变迁之下出现的新现象。在公共行政变迁的大背景之下,反思传统行政权理论,对行政权的属性进行重新界定,对解释行政法上的控权理论从而实现最佳行政之目的具有重大理论和实践意义。With the appearance of privatization and administrative outsourcing, government functions shift gradually into the society. The change of public administration makes the definition of traditional public administration face challenge.＂Administrative power＂itself is a dynamic concept and age offers administrative power with the new content. Administrative power with the characteristics of being indispesitive, mandatory, objected to the will of state is insufficient to explain the new phenomenon under the changes of public administration. Reflecting the theory of traditional administrative power and redefining the property of administrative power in the background of the changes of public administration hold theoretical and practical significance in explaining controlling theory of administrative power and achieving the best political purpose.
