摘　　要：从与贪污贿赂罪区分的角度,阐述了商业贿赂罪的概念。探讨了商务贿赂犯罪的危害,主要是破坏正常的经济秩序,妨碍政府的廉洁运作。对非国家工作人员受贿罪和对非国家工作人员行贿罪的修订进行了分析:改变了犯罪构成的层次,扩大了打击的范围,强调了国内企业应遵循的国际义务,以保障社会主义市场经济的健康发展。With the reinforcement of the national macro-control market economy, the concept of commercial bribery is described. The harms of commercial bribery criminal are discussed, which are mainly including destroying the normal economy order, and hindering the government operation. The bribery and its revision of non-national public servant are analyzed, the level of crime constitution is changed, the range of strike is extended, it emphasizes that the enterprises in China must follow the international obligation to ensure the development of socialist market economy.
