摘　　要：在刑事诉讼中,强制采样是侦查机关经常使用的一种侦查方法。为了厘清强制采样的有关问题,以域外国家的立法与司法实践为基础,详细论述了强制采样的法律性质,强制采样的程序控制,包括强制采样的批准程序、强制采样的告知程序、强制采样的实施程序、强制采样样本与资料的处理程序,强制采样证据的证据能力;在此基础上,考察了中国强制采样制度的立法与司法实践,并对如何构建中国的强制采样制度提出了自己的设想。In the criminal lawsuit, the compulsive sampling is a kind of investigating way often used by the investigation organ. In order to clarify the related problems of the compulsive sampling, the article is based on the legislation and the judicial practice in domestic and overseas countries as a foundation, having elaborated the legal nature of the compulsive sampling, the program control of that ,including the ratification procedure of that,the noticing procedure of that, the implementing procedure of that, the processing program of sample and data of that, the evidence ability got by compulsive sampling; On this basis, having investigated the legislation and the judicial practice of the system of the compulsive sampling in China, put out the ideas of my own on how to construct the system of the compulsive sampling in China.
