摘　　要：证券投资基金业在我国证券市场地位愈发显得举足轻重,这种间接的投资方式,因其相对于直接投资股票、债券,具有风险系数低、回报率较高的特点,获得了广大投资者的青睐。然而,由于相关法律法规的滞后,证券投资基金业存在大量的违规、违法、甚至犯罪行为,其中违反信息披露义务的问题尤为突出,应加强对违反信息、披露义务的刑事责任构建的研究。The securities investment fund industry in China＇s securities market position becomes more anti more important. This indirect investment, because of its low risk and higher returns compared with direct investment stocks and bonds, wins the favor of the majority of investment persons. However, due to the lag of the relevant laws and regulations, securities investment fund industry has a lot of irregularities, illegal problems, or even criminal acts, among them, the breach of information disclosure obligations is particularly prominent, From the perspective of securities investment fund managers, we explore the basis of its right and seek the framework of penalties and criminal liability.
