摘　　要：国务院将《国有土地上房屋征收与补偿条例》第一次公开征求意见稿中关于商业拆迁的规定全部删去,这在法规实际施行中会引发一系列的问题,亟待解决。对关于商业拆迁的中国法制进程进行详细梳理,结合我国现实状况,解决新法带来的问题,需要同步立法,对商业拆迁进行专门规范;构建一个和谐、有效的商业拆迁运行模式。The regulations about commercial demolition, which is regulated in Regulation on Expropriation of Houses on Stateowned Lant and Compensation of the State Council （the First Draft for Discussion）, are completely deleted, which caused a series of problems in practical executing and needs to be solved. According to the present situation, we comb the Chinese legal procedures of commercial demolition in detail. To resolve the problems caused by new laws. we need to normalize commercial demolition by synchronous legislation.
